We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), to the extent they apply to us. Because we provide fitness, assessment and related health-adjacent services and may collect health information, we treat privacy as a core obligation even if a small-business exemption would otherwise apply.

2. The kinds of personal information we collect

Depending on how you deal with us, we may collect:

  • Identity and contact details: name, email, mobile number, address, date of birth, emergency contact.
  • Booking and account details: session history, packages purchased, attendance, preferred trainer, Mindbody (or similar) client profile information.
  • Payment information: billing name and limited payment metadata. Full card numbers are processed by our payment providers; we do not store full card details.
  • Health and fitness information (sensitive information): pre-exercise screening answers, injuries, medical conditions, medications you choose to disclose, body composition or assessment measurements, training goals, nutrition-related information you provide, and notes needed to train you safely.
  • Photos and videos: progress photos, transformation images, or studio footage if you consent.
  • Communications: messages sent via our website form, email, SMS or phone.
  • Website and device data: IP address, browser type, pages viewed, cookies and similar technologies (see section 9).

We only collect sensitive (including health) information where it is reasonably necessary for our services and, where required, with your consent — for example when you complete a health screen or book a transformation program.

3. How we collect information

We collect information:

  • Directly from you — website forms, booking systems, in-studio paperwork, assessments, email, phone and messaging; from people acting for you (for example a partner booking a shared session), with your knowledge; from third-party platforms you use to deal with us, including Mindbody Online (bookings and client management) and payment processors; automatically when you use our website (cookies, analytics); and
  • From publicly available sources only where reasonably necessary (for example if you tag us on social media and we respond).

If you do not provide information we reasonably need (for example a health screen before training), we may be unable to provide some or all services safely.

4. Why we collect, hold and use personal information

We collect and use personal information to:

  • Provide personal training, group training, assessments, nutrition guidance and HI-EMT / body-sculpting treatments;
  • Assess fitness readiness and deliver training safely and appropriately;
  • Manage bookings, packages, waitlists, cancellations and payments;
  • Communicate about sessions, reminders, schedule changes and studio operations;
  • Respond to enquiries and complaints;
  • Improve our programs, studio operations and website;
  • Send marketing about our services where permitted (you can opt out at any time);
  • Comply with legal obligations and protect our rights, staff and clients; and
  • With separate consent, publish transformation photos or testimonials.

5. Who we disclose information to

We may disclose personal information to:

  • Our trainers, coaches and authorised studio staff who need it to deliver services;
  • Service providers who help us operate, including booking software (currently Mindbody), payment processors, website hosting, email/SMS providers, accountants and IT support;
  • Professional advisers (lawyers, insurers) where reasonably necessary;
  • Emergency services or health professionals if there is a genuine emergency or serious health risk; and
  • Regulators, courts or law enforcement if required or authorised by law.

We do not sell your personal information. Some providers (for example cloud booking or payment platforms) may store or access data outside Australia. Where that occurs, we take reasonable steps to ensure they handle the information in a way that is consistent with the APPs, including contractual and security measures available to us.

6. Storage, security and retention

We hold information in paper files at the studio and in electronic systems (including third-party platforms). We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure. Those steps include restricted staff access, password-protected systems, and limiting paper records to what is needed.

No method of transmission or storage is completely secure. Please keep your own booking-login details confidential.

We keep personal information only as long as we need it for the purposes above, or as required by law (for example tax and insurance records). Health and training notes are typically retained for a period consistent with potential legal claims and then securely destroyed or de-identified.

7. Access, correction and your choices

You may request access to the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. We will respond within a reasonable time (generally 30 days). In limited circumstances the Privacy Act allows us to refuse access; if we do, we will explain why (unless it is unreasonable to do so) and how you can complain.

You may withdraw consent to marketing at any time by emailing us or using an unsubscribe link. You may also ask us to stop using photos of you for

promotion.

You may request that we delete information that we no longer need, subject to legal retention requirements.

8. Complaints

If you are concerned about how we have handled your personal information, please contact us first at info@RoseberyPersonalTraining.com.au or write to Suite 103, 30–40 Harcourt Parade, Rosebery NSW 2018. Please include your name, contact details and a description of the issue.

We will acknowledge your complaint and aim to respond substantively within 30 days. If you are not satisfied, you may complain to the Office of the Australian Information Commissioner (OAIC): www.oaic.gov.au or 1300 363 992.

9. Cookies and our website

Our website may use cookies and similar technologies to operate the site, remember preferences, measure traffic and (if enabled) support advertising. You can control cookies through your browser settings. Blocking some cookies may affect site features, including booking widgets.

Third-party tools embedded on the site (for example Mindbody booking widgets, Google services or social media plugins) may set their own cookies.

Their privacy policies apply to that activity.

10. Children and young people

Our services are generally intended for adults. If a person under 18 trains with us, a parent or guardian must provide required information and consent. We do not knowingly collect personal information from children for marketing.

11. Changes to this policy

We may update this Privacy Policy from time to time. The current version will be published on our website with an updated date. Material changes will be notified by website notice or email where reasonably practicable.
